A court sentences a girl from Elche to 40 years for the murder of two newborn babies
A court in Alicante has sentenced a young woman from Elche to 40 years in prison for the murder of her two newborn babies
A young woman from Elche, in the province of Alicante, who murdered her two newborn babies, was sentenced on Friday January 14. She was sentenced to 40 years in prison, by the seventh section of the Provincial Court of Alicante, after a jury returned a guilty verdict.
The court informed the culprit that the conviction can be appealed to the civil and criminal chamber of the Superior Court of Justice of the Valencian Community (TSJCV).
As the court heard, this incident occurred on January 30, 2020, when the defendant, then 18, locked herself in the bathroom of the Elche home she shared with his mother, stepfather and younger brother. According to the court ruling, she then gave birth to two babies in the bathroom, without asking for any help.
She first gave birth to a baby “with the intention of ending her life, or at least representing the possibility of that happening, and assuming said outcome, she immediately placed him in a bag in plastic”.
Then she gave birth to the second baby, which she put in the same bag as the first. Both infants died of suffocation, as they were also covered in towels.
Sentencing the mother to twenty years for each of her crimes of murder for treason, the judge clarified that “doctors from the histopathology service of the National Institute of Toxicology declared that the newborns did not present any birth defects “.
He added that “they had a degree of maturity according to age included in the autopsy report, and without signs of fetal distress. Therefore, it is considered proven that the defendant, by placing the newborns in a bag and covering it with towels, caused their death”.
“The behavior of the young woman does not accord with any mitigating or mitigating circumstances of criminal responsibility, the Jury having declared that the defendant suffered from an intellectual disability which would lead him to be unaware of the consequences of his actions”.
Regarding the sentence to be imposed, the Alicante court took into account not only the age of the defendant, but also the fact that she had to manage the pregnancy and the birth of the babies on her own. She did so without the support of her partner, who, although he had agreed with her to continue the pregnancy, she had abandoned him in the weeks before giving birth.
Added to this is the fact that the family of the young woman, as noted by the court, “had warned her insistently that it was crazy that she had a baby with her boyfriend, since they had no no way to maintain an independent life”.
“These circumstances must be taken into account to establish the minimum possible prison sentence of twenty years in prison for each murder, plus absolute disqualification for the time of the sentence,” said the judgment, reported by 20minutes.es.
