Supreme Court blocks Biden’s OSHA Vax mandate for private companies

The US Supreme Court on Thursday blocked Joe Biden’s OSHA vaccination mandate for companies with more than 100 employees.

However, the conservative majority allowed the health workers’ rule to remain: Justices Roberts and Kavanaugh sided with the liberals.

“While Congress has indisputably given OSHA the power to regulate workplace hazards, it has not given that agency the power to regulate public health more broadly,” the court wrote in an unsigned opinion.

“Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls into the latter category,” the court wrote.

On Thursday, the Supreme Court blocked the Biden administration from enforcing its extensive vaccine or testing requirements for large private companies, but allowed similar requirements for medical facilities that accept Medicare or Medicaid payments.

The failures came three days after the Occupational Safety and Health Administration’s emergency measure took effect.

That mandate required workers in companies with 100 or more employees to be vaccinated or submit a negative Covid test weekly to enter the workplace. It also required unvaccinated workers to wear masks while on the job.

Chief Justice John Roberts, who was appointed by President George W. Bush, said during arguments that he thinks it is difficult to argue that the 1970 law governing OSHA “gives free rein to agencies to enact regulation. so wide ”.
